provided that the Sharing is not taking place by a worldwide effective publishing of the Licensed Material; and these countries and their institutions are not allowed for their part to possess or use the Licensed Material in whatever manner, also as a part of a larger work.

  • Repair means to alter parts or features of the Licensed Material, also by removing, adding or rearranging parts, which prevent effectively the intended usage of the Licensed Material in a usual manner, due to their nature, state, functionality or working, as far as necessary to enable the intended usage, but not otherwise; where the intention of the usage can only be determined, either in the manner that the respective usage of the Licensed Material is usually intended undoubtedly, due to its kind (e.g. a vehicle is intended to be driven, a computer program is intended to be executed and an artwork is intended to be perceived), or at the time of the repair the Licensed Material has been specified or documented by the Licensor to such an extend that the respective intention can be inferred from it directly, unambiguously and undoubtedly. For purposes of this Public License an effective prevention of the intended usage of the Licensed Materials is given as well, if the preventing circumstances occurred after the beginning of the usage, e.g. due to updates of the (technical or physical) environment on which the usage of the Licensed Material depends. Repaired has a corresponding meaning.

  • Sui Generis Database Rights means rights other than copyright resulting from Directive 96/9/EC of the European Parliament and of the Council of 11 March 1996 on the legal protection of databases, as amended and/or succeeded, as well as other essentially equivalent rights anywhere in the world.

  • Designated to receive attribution means that the Licensor requires to mention the name(s), when Sharing the Licensed Material, in the same manner in which the Licensor must be mentioned as the creator; either required explicitly by message, issue with the Licensed Material or Publication, or required implicitly when these name(s) is (are) mentioned in a similar way the Licensor mentioned himself as the creator on the issue or publishing of the Licensed Material.

  • Reasonable manner requested by the Licensor means the form to mention the name(s), which the Licensor requires when Sharing the Licensed Material; either required explicitly by message, issue with the Licensed Material or Publication, or required implicitly by the
